Miami Commissioner Michelle Spence-Jones running for reelection




















Eight years have passed since Michelle Spence-Jones was elected to the Miami City Commission.

She isn’t willing to leave just yet.

Spence-Jones — who was charged with bribery and grand theft in 2009, suspended from office, acquitted and reinstated to her post — is seeking reelection, she announced Friday. She represents District 5, which includes Overtown, Little Haiti and Liberty City.





Whether Spence-Jones could run again has been the subject of much debate. The Miami city charter limits commissioners to two terms and Spence-Jones has twice won election. But City Attorney Julie O. Bru opined that Spence-Jones could run again because her second term was interrupted by the suspension.

“Our charter prohibits a commissioner or the mayor for running for reelection after that commissioner or mayor has served two consecutive terms,” Bru reaffirmed to Spence-Jones at a City Commission meeting Thursday. “You are eligible to seek reelection because you did not serve two full consecutive terms.”

Spence-Jones’s opponent isn’t buying it.

“The bottom line is, Michelle is term limited,” said the Rev. Richard P. Dunn II, who held the commission seat in Spence-Jones’s absence. “She received financial compensation for the time she was away and she was fully vested in the pension. Are the citizens of Miami going to pay her twice?”

Dunn plans to file a legal challenge “immediately,” he said.

Spence-Jones wants the additional term, she said, “to finish what I started.”

She pointed to the improvements she’s spearheaded along Northeast Second Avenue in Little Haiti. “We cleaned the place up, repainted many of the buildings and recreated a Caribbean feel by adding steeples,” she said.

The ultimate goal, Spence-Jones said, is to make Little Haiti a destination for tourists akin to Little Havana’s Calle Ocho. She has a similar vision for Overtown, which was once the cultural hub of Miami’s black community. To that end, Spence-Jones pushed for improvements to Northwest Third Avenue and provided grant money for local businesses.

“Now we’re going to move forward with a marketing campaign and build relationships with cruise lines and tour operators,” Spence-Jones said. “But these sorts of things take time.”

Other big projects are in the works.

Earlier this year, Spence-Jones pushed through a $50 million bond issue for improvements in Overtown — the largest investment the blighted community has seen in decades. The money will go toward affordable housing and some retail projects.

But Spence-Jones takes an equal amount of pride in some of her smaller initiatives, including a project that brought Hollywood director Robert Townsend to Overtown to film an independent movie. Students from the University of Miami and several local high schools had the opportunity to serve as interns. The film will debut this summer.

She plans to focus future efforts on Liberty City. She is already laying the groundwork for a program that will train residents to become laboratory technicians. A second program will help people with criminal records pursue careers in the automotive industry.

Spence-Jones’s tenure has been somewhat of a rollercoaster. After being elected to her second term, she was charged with bribery and grand theft in two separate cases and removed from office by then-Gov. Charlie Crist. Jurors later acquitted her of bribery, and prosecutors dropped the grand-theft charges.

A vindicated Spence-Jones returned to City Hall in August with newfound political heft.

Spence-Jones is now suing Miami-Dade State Attorney Katherine Fernández Rundle and Miami Mayor Tomás Regalado, accusing them of conspiring to destroy her political career via the prosecutions. She declined to talk about the suit, saying only: “I’m going to let my lawyers fight that battle.”

She may have another legal fight ahead.

Dunn believes the city attorney’s opinion giving Spence-Jones the go-ahead to run again won’t withstand a legal challenge. He says Spence-Jones has served two consecutive terms because she was paid for two consecutive terms.

Dunn also criticized the city attorney, saying she likely felt pressured to give that opinion because Spence-Jones is her boss.

“If it stands up in a court of law, I will respect that,” said Dunn, who attended Thursday’s commission meeting and took notes on a legal pad. “But I’m not going to be whitewashed by a city attorney’s opinion that’s biased by her boss’s posturing position.”

Dunn, who also sat on the commission in the mid-‘90s after Commissioner Miller Dawkins was removed from office, pointed to his own accomplishments as a commissioner. He said he helped secure funding for Gibson Park,and quelled racial tensions after Miami police officers shot and killed seven black men in 2010 and 2011.

“Michelle Spence-Jones does not own that seat,” he said. “It’s owned by the people of District 5.”

No other candidates have announced they are running for the post.

Hackers claim attack on Justice Department website






WASHINGTON (Reuters) – Hackers sympathetic to the late computer prodigy Aaron Swartz claimed on Saturday to have infiltrated the website of the U.S. Justice Department’s Sentencing Commission, and said they planned to release government data.


The Sentencing Commission site, www.ussc.gov , was shut down early Saturday.






Identifying themselves as Anonymous, a loosely organized group of unknown provenance associated with a range of recent online actions, the hackers voiced outrage over Swartz’ suicide on January 11.


In a video posted online, the hackers criticized the government’s prosecution of Swartz, who had been facing trial on charges that he used the Massachusetts Institute of Technology‘s computer networks to steal more than 4 million articles from JSTOR, an online archive and journal distribution service.


Swartz had faced a maximum sentence of 31 years in prison and fines of up to $ 1 million.


The FBI is investigating the attack, according to Richard McFeely, of the bureau’s Criminal, Cyber, Response, and Services Branch.


“We were aware as soon as it happened and are handling it as a criminal investigation,” McFeely said in an emailed statement. “We are always concerned when someone illegally accesses another person’s or government agency’s network.”

Unless something was lost in translation, Leonardo DiCaprio has revealed to a German publication that he will be taking a hiatus from acting.

The 38-year-old A-lister told Germany's daily Bild (via Deadline), "I am a bit drained. I'm now going to take a long, long break. I've done three films in two years and I'm just worn out."

DiCaprio's Django Unchained just came out this past month and he also has The Great Gatsby hitting theaters this year (May 10th) as well as The Wolf of Wall Street. So, what does DiCaprio plan to do with his free time? "I would like to improve the world a bit. I will fly around the world doing good for the environment."

The actor added, "My roof is covered with solar panels. My car is electric. A normal person does not drive more than 50 kilometers (31 miles) a day. That can be done with a plug."

Two arrested for stealing Hurricane Sandy relief supplies from Staten Island church








“It’s like stealing from God.”

A pair of heartless fiends were arrested yesterday after they were caught stealing donated supplies for Hurricane Sandy victims from a church.

Edwin Rios, 46, of Arden Heights, and William Banks, 43, of St. George, were nabbed at the Christian Pentecostal Church early Friday trying to put 35 cases of bottled water into a rented truck.

“When you see creeps like this, it bothers me. If you need it, come get it, but when you take stuff like this it’s like stealing from God,” Pastor Dr. John Rocco Carlo told the Staten Island Advance.




Carlo, a retired NYPD detective, said the thefts began before Thanksgiving, and he reached out to police. The church has been a lifeline for Sandy victims still in need of help.

“I’m glad they caught two of the guys. But to me it looks like a gang, you don’t just operate like this with a couple of people,” Carlo surmised.

The thieves had been hoisting themselves over walls to get into the locked parking lot where the supplies were stored and making off with blankets, diapers, cleaning supplies and other items.

The NYPD set up a sting operation, leaving the parking lot gate open.

Rios and Banks were charged with criminal possession of a controlled substance, petty larceny and criminal trespass.

Fed aims for a 6.5% jobless rate




















Six and a half percent unemployment in America would mean almost 2.1 million more people working than today. At the rate the country has been creating new jobs each month, it would take more than a year to find work for that many people.

Keep 6.5 percent in mind this week when the Federal Reserve meets Tuesday and Wednesday to talk about its efforts to push interest rates down. The hope is that the cheap cash will spur on investment leading to job creation. After all, the central bank has promised to keep its target interest rate near zero as long as more than 6.5 percent of Americans in the workforce are without work. The Fed has put other conditions on maintaining its historically low interest rate such as low inflation, but official measures remain tame. So its job growth the Fed is looking for.

It won’t have to wait long for the latest update. On Friday the first jobs report of 2013 will be released. Hiring has been a slow grind but it has been positive.





Finding work in January, though, can be tricky. Winter weather, a hangover from the holidays and seasonal work ending can slow down hiring.

It will be months, maybe even a couple of years before the U.S. unemployment rate hits 6.5 percent. There is nothing magical about that number, but as long as the Federal Reserve has it in its sights, so should we.

Fundraiser at Alper JCC to help kids with special needs




















Judy Mezey and Lisa Leventhal will return as chairs for the 17th annual Special Needs Fundraiser on Feb. 9 at the Alper JCC, 11155 SW 112th Ave. Their dedicated committee members include Suzie Fisher, Joanne Gentile, Renee Gershen, Teri Hirschberg, Lynn Katzen, Tobe Marmorstein, Sharon Samole, and Carol Stiefel.

Six have been involved with planning the event for 15 years or more.

This year the theme is “Music of the 60’s” featuring Jay Siegel and The Tokens. Siegel was on the original recording of the 1961 doo-wop hit single The Lion Sleeps Tonight. Proceeds from the concert, silent auction and gourmet dessert reception benefit the Alper JCC’s Shirley and Chester Paul Special Needs Program.





Mezey started the life cycle program 27 years ago for children who were often left out of socialization experiences such as birthday parties, play dates and club groups. The program was launched in 1990 and is thriving. There is a full summer camp and no-school holiday classes for children, ages four and up, with cognitive and/or physical disabilities. There are also programs for special needs teens and young adults. The fundraiser is a necessity to keep the programs going.

“This is a great evening,” Mezey said in a release. “The money that we raise supports the majority of this program throughout the year. It allows the kids to go on field trips…and also provides funding for scholarships.”

TRIBUTE TO MILITARY

Just after midnight on Feb. 3, 1943, the United States Army Transport Dorchester sunk in the icy North Atlantic Ocean after being hit 20 minutes earlier by a German submarine’s torpedo fire. The ship was about 100 miles from Narsarsuak, Greenland. Of the 902 men on board, only 230 survived.

On the transport were four Army Chaplains: Father John Washington, Roman Catholic; Reverend Clark Poling, Dutch Reformed; Rabbi Alexander Goode, Jewish;

and Rev. George Fox, Methodist. And according to survivor reports, the religious men sacrificed their lives to help save others.

As the story is told on www.greatships.net, “The four chaplains found a deck box full of lifebelts and together started assisting the men who were without into the belts and overboard. Soon the box was empty. The Chaplains, one by one, removed their own lifebelts and gave them to men who had none. The Chaplains locked arms, sang and prayed for the men as the Dorchester sank with them on board.”

Thanks to its association with the now-defunct Megaupload — and the legal issues facing its founder Kim Dotcom — the amount of press, user interest and hype surrounding Mega is greater than any file hosting/cloud storage launch in recent memory.


According to Dotcom, more than 1 million users signed up for Mega in the first 24 hours. On Twitter, the larger-than-life entrepreneur has continued to share usage stats and traffic graphs that compare Mega with perennial cloud favorite, Dropbox.

The Phoenix of Megaupload


Mega is the spiritual successor to Kim Dotcom’s last business, the insanely popular file-hosting service Megaupload. Last year, the U.S. Department of Justice shut down Megaupload and pursued criminal charges against Dotcom. Dotcom, a New Zealand citizen, is actively fighting U.S. extradition orders.


Megaupload was targeted by the DoJ because of its role in illegally distributing copyright material — including digital copies of movies, TV shows, books, music and software.


Rather than try to start a new service eschewing the potential for copyright material to be uploaded and shared, Dotcom is positioning Mega as a service that cares about and protects its user’s privacy. In fact, Mega’s tagline is “the privacy company.”


How It Works


On the surface, Mega is a bare-bones cloud storage host. After signing up for accounts, users can upload files and folders of all types to the service. Those files can then be shared with others.


The free plan gives users 50GB of file storage. There are no hard limits on file size, meaning users can use Mega as a way to back up photos, documents and other data. Obviously, this means users can use Mega as a way to store media content — video files, music, DVD images — as well.


For now, Mega is optimized to work on desktop web browsers. Mega strongly encourages users to use Google Chrome. And while Mega has big plans for developers and client-side apps, for now, the only way to access files is via the web browser.


Files can be uploaded to the service using drag and drop or a file-upload menu. Users can create folders in the file manager.


Uploads and downloads take place in parallel. If you upload a large number of files at once, each file uploads one at a time. In the future, Mega says users will be able to change the upload order. If you need to upload or download multiple files at once, simply open a new Mega tab in your browser and select that file.


You can upgrade to a higher-tiered storage plan from within your account. Mega doesn’t sell these plans itself; instead it has resellers who sell vouchers for a service. A 500GB storage plan with 1TB of enhanced bandwidth is 9.99 euros a month or 99 euros a year (a little over $ 110 U.S. dollars). That’s cheaper than most of its competitors.


The Importance of Passwords


It’s very important to remember the password you select when setting up your Mega account. The password is a big part of how Mega encrypts data on both ends.


During the sign-up process, Mega uses your password to create a 2,048-bit RSA key. This is the key that tells the system you are who you say you are. If you forget your password, you’re not going to be able to get into your account.


Right now, Mega doesn’t even have a password reset or recovery feature. In the future, Mega says it will have a reset mechanism but it will only allow users access to files or folders they have file keys for (more on file keys below). Users won’t be able to access other files until or unless they remember their password.


Because your Mega password is also your master encryption key, it’s important that users choose a secure password. We recommend using a password manager and printing a copy of the password to store in a safe place.


Understanding File Security


Mega is focused on end-to-end encryption. This means that files are encrypted both on upload and on download. With most traditional file hosts or cloud storage lockers, a public link to a file also includes a file path. With Dropbox, for example, the public or shared link includes the file name.


With Mega, things are a bit different. While users can share specific files to other Mega users or via email, the URL to a file doesn’t contain a file name; instead, a cryptographic key is appended to the URL. Without this key, you can’t access the file. Once decrypted by the server, a user has the option to download the linked file.


Mega’s promise, in other words, is that users control who has access to their files and accounts and no one else.


For important files or folders, users might want to make a note of the file key and keep it in a safe place — if they are worried about getting locked out of their account.


How Safe Are Your Files


Since Mega is touting itself as “the privacy company,” it’s important to look at how the company stores files and content.


The end-to-end encryption scheme is only part of how Mega secures data. Still, some are already criticizing the service, noting that it’s not as secure as it says it is. An article for Forbes cites two professionals who have problems with Mega’s security.


Matthew Green, a cryptography professor at John Hopkins University, is particularly critical of the way Mega uses JavaScript to verify its encryption method telling Forbes that “it makes no sense.”


Mega has responded to Green’s claims on its own blog, noting that its scheme “basically enables us to host the extremely integrity-sensitive static content on a large number of geographically diverse servers without worrying about security.”


Meanwhile, at Ars Technia Lee Hutchinson raises concerns about how Mega comes up with its crypto key at sign-up, as well as how the company handles deduplication, or how it eliminates duplicate copies of data.


Again, Mega has taken to its blog to attempt to clarify its policies and the way it handles data.


While Mega’s crypto system certainly doesn’t seem any less secure than any other file locker, we do agree with critics who note that the system might be more about giving Mega culpability against claims that it knows infringing content is on its servers, rather than about protecting that data itself.


The service is still in beta and much of its code is available via open source, so security purists might want to watch how Mega’s system evolves before trusting it with important, sensitive data.


Will Mega Stick Around?


While security experts can quibble and argue over the way Mega uses cryptography and how it stores data on its array of servers, the bigger issue, for us, is long-term survival.


While I would argue that most users who actively used Megaupload were not using it as a traditional cloud service, the fact remains that when the service was shut down, user files went with it.


Already anti-piracy groups are campaigning to shut down payment processors to Mega’s resellers. One of the reasons Mega isn’t taking payments itself and is instead using resellers is to prevent those groups from shutting down payment processors or trying to seize funds.


This is worrisome because in addition to outside capital, Mega needs professional accounts to keep its site working.


It’s too early to say if Mega will be around for the long haul or not, but our advice is not to use Mega as your only file storage solution. Keep backups of crucial files on disk or other cloud-based services.

Ex-Senator Huntley will cop to mail fraud; pol still faces charges in $30G charity 'sham'








Former New York state Sen. Shirley Huntley is planning to plead guilty to mail fraud charges in a new federal case leveled against her, The Post has learned.

The Queens Democrat is expected to admit that she used funds from a non-profit organization to benefit herself and family members, a source said.

The embattled ex-legislator was indicted originally on Aug. 27 by state authorities on charges that she falsified documents to conceal the fact that her niece and an aide allegedly siphoned $30,000 from a sham charity she created. She pleaded not guilty to those state charges.

But Brooklyn federal prosecutors working in the US Attorney's Office's public corruption unit quietly opened a mail fraud case against Huntley — and now she is poised to surrender to authorities soon with the intention of entering a guilty plea, sources said.

A spokesman for the US Attorney's Office in Brooklyn declined to comment on the case against Huntley.

Several months ago, Huntley was bounced out of office by voters who rejected her in a Democratic primary vote.

The Queens lawmaker was trounced by Councilman James Sanders, who got 4,979 votes, or 57 percent of the tally, to 3,477 votes, or 40 percent, for Huntley, records show.

On her way out the door, Huntley paused long enough as a lame-duck legislator, however, to showered loyal staffers with lucrative pay raises.

The Queens Democrat promoted several pet staffers and granted them salary hikes, records show.

Lennar design accommodates multigenerational families




















In some cases, it may be Grandma moving in with the family. Other times, it may be a recent college graduate returning to the nest.

For all sorts of reasons — financial, medical, personal — a rising number of Americans are moving into extended family households.

Spotting a niche in the growing trend, Lennar Corp. has launched a new concept tailor-made for multigenerational family living.





It’s basically a house within a house: a smaller living unit next to the main home designed to provide independence but also access to the rest of the family household.

“People are really loving the whole concept,” said Carlos Gonzalez, president of the southeast Florida division of Lennar, a Miami-based home-building giant. “We adapted to the market from a design standpoint.”

In Miami-Dade County, Lennar is selling various versions of multigenerational homes in three new developments in Doral, Kendall and Homestead.

Louis Moreno of Kendall and his wife, Danilza Velez, signed a contract for a large NextGen home in The Vineyards development in Homestead last October — even before the models had been built.

“We loved it,” said Moreno, a 45-year-old engineer.

Moreno said his mother-in-law will be able to use the new suite when she visits, as will his family members who frequently come to town from Puerto Rico. “This will provide them with more comfortable space and more privacy,” he said. He also plans to use it as a game room and entertainment area.

The two-story Zinfandel home Moreno picked has three bedrooms and 2 1/2 bathrooms in the main home with a family room and two-car garage. In addition, it has an ample 789-square-foot suite with two bedrooms, a bathroom and a kitchenette. The suite has its own garage, a separate front entrance and an internal door connecting to the main home.

The Zinfandel, which has 2,249 square feet of air-conditioned space in the main house, starts at $283,990 in the Homestead community at 128 SE 28th Ter., but a similar home in Kendall would run about $100,000 more, primarily because of higher land costs, Fernandez said. (In Doral, there is a NextGen home priced at $677,990.)

Some multigenerational models have suites as small as 489 square feet, but all have a separate entrance, a bedroom, a bathroom and some sort of kitchen space.

The idea takes various shapes. One option at the Kendall Square development at 16950 SW 90th St. is a Granny unit above a detached garage.

“Independence is the key word,” said Frank Fernandez, director of sales and marketing for the southeast Florida division.

Depending on local zoning rules, some homes can have full kitchens, others are restricted to kitchenettes with a microwave but no stove. Similarly, some municipalities permit the space to be used as a rental, others prohibit it.

The choice is proving popular. Fernandez said in The Vineyards development in Homestead, 10 of the 14 homes sold to date are NextGen. At Kendall Square, 35 of 107 sales are multigenerational, and at the Isles at Grand Bay development at 11301 NW 74th Street in Doral, five of 48 houses are.

Adapting homes for special needs, such as wheelchairs and safety railings, is done at cost, Fernandez said: “That is company policy.”

As one of the nation’s largest home builders, Lennar has been rebounding strongly from the housing crash. Last week, the builder, whose shares trade on the New York Stock Exchange, posted better than expected earnings for the fourth quarter and fiscal year ended Nov. 30, 2012.

Youth Crime Watch helps kids take a bite out of crime




















Last week’s column generated several emails from you asking if Youth Crime Watch is in every school. Unfortunately due to budgets, we are not, but we do service those that contact us. Therefore I asked our program director, Joel Mesa, to write my column for today to enlighten my readers about our program.

Youth Crime Watch of Miami-Dade County serves nearly 35,000 students per school year via youth crime prevention presentations, safety projects, YCW club meetings, assemblies, rallies, and special events. Our YCW School Coordinators conduct more than 500 presentations per school year at the Miami-Dade schools on: YCW orientations, YCW installation, YCW appreciation, reporting crimes, school safety, school violence prevention, bullying and cyberbullying prevention, sexting prevention, stranger danger, personal safety, drug prevention, gun prevention, character education, cyber safety, anger management, McGruff the Crime Dog, and much more.

I have experienced at first-hand the dominant factors that youth crime prevention education has in molding our future leaders to strive for success and strengthen our school communities. The students are the “eyes and ears” of our schools. They are the primary stakeholders in preventing crime at their schools by educating their peers on safety topics and by anonymously reporting threats and warning signs that can lead to violent incidents. However, they cannot do this without adequate training. YCW of Miami-Dade County’s primary mission is to provide them the training and skills to make their safety visions an observable reality. It is a mission that has been possible year after year.





Children and young people can be so vulnerable to fall for the ills of school crime. Youth Crime Watch of Miami-Dade County has been healing those ills throughout the last 33 years by implementing programs in the Miami-Dade schools. YCW of Miami-Dade County was selected as the National Crime Prevention Program of the Year by the National Crime Prevention Council. YCW educates students on safety skills which in turn the youth apply those skills in their schools to promote safe school environments, educate their peers on youth crime prevention, and curb school crime. The organization also provides students and faculty a multitude of crime prevention materials so the safety education can be reinforced in the classroom lessons and in YCW club activities. YCW is also the premier organization which has McGruff the Crime Dog appear at Miami-Dade school safety functions and help kids “take a bite out of crime.”

School crime statistics and survey assessments have continuously demonstrated that schools with YCW programs have lower crime rates and safer school environments. This in turn is a contributing factor in academic achievement. A child that is fearful of being bullied and harassed will prioritize their fear over their academics. On the other side of the “safety spectrum”, those children that feel comfortable and safe in their school environments will be more motivated & determined to focus on their academics.

Women in Combat Stoke Twitter Debate






The Pentagon’s decision to allow women in combat has elicited some strong and controversial words from opponents of the move.


First, Tucker Carlson. Last night, the Daily Caller publisher tweeted: “Feminism’s latest victory: the right to get your limbs blown off in war. Congratulations.”






This drew some swift criticism on Twitter, and a counterpoint from The Week’s Marc Ambinder, who noted that one woman who lost limbs in combat, Tammy Duckworth, is now serving as a Democrat in the House of Representatives.


Then, Politico reported that Allen West, the former GOP congressman and Army lieutenant colonel, tweeted this morning: “Women in combat billets? Another misconceived lib vision of fairness and equality.”


West is already getting trashed on Twitter by users who took offense. After the controversial remarks made by Newt Gingrich in the mid-1990s and Rick Santorum last year, it’s no surprise that the Pentagon’s decision is stirring debate.

Family of slain highway worker 'saddened' by drunk driver's easy sentence








Loved ones of a highway worker who was killed by a drunk and unlicensed driver on the Grand Central Parkway last summer said they were “saddened” by his assailant’s lenient sentence.

"This is still fresh to me," said Israel Rosario, who witnessed Abdullah Munshi slam a 2002 Audi A6 into his 63-year-old co-worker, Frank Avino as they were setting up traffic cones near the Jewel Avenue exit of the highway on July 10.

"We were preparing to repair the lights on the highway, the car passed me first and hit Frank. I heard a very short shriek and Frank was gone," said an emotional Rosario as a fellow co-worker consoled him outside of Queens Criminal court.




Munshi, 26, dodged up to 15 years in prison when he plead guilty to second-degree vehicular manslaughter -- a non-violent felony -- and will be sentenced to 2 1/3 to 7 years in prison on March 12, said Queens District Attorney Richard A. Brown.

"I understand vehicular manslaughter is a non-violent crime and we need to change that. My husband was killed...it is saddens me," said Avino's heartbroken wife, Patricia.

"It's hard for me to hear a kid before [Munshi's] case was called get threatened to be put into jail for 1 1/2 to 3 years for a marijuana charge and he didn't kill anyone, yet this guy gets almost the same amount time, its not fair," said Rosario, who worked with Avino, an electrician for Welsbach Electric Corp for seven years.

Patricia is hoping to work with the Mothers Against Drunk Drivers (MADD) in order to help with "changing the laws" when intoxicated drivers are charged.

Munshi, a citizen of Qatar, admitted to prosecutor, John Kosinski, that he drank alcohol before he got into the car with his friends and also "purchased beer" at a corner store before the 11 a.m. crash.

The reckless driver was unable to produce a valid NYS driver's license and also admitted that he was driving a "friend's car" because "they were too drunk to drive," said Brown.

At the scene, Munshi's blood alcohol content read .21 percent -- well above the legal limit of .08 percent in New York.

Following Munshi's release from prison he is ordered to a three-year conditional discharge and install an ignition interlock into any car he owns for five years -- at his own expense.

Munshi also faces deportation.

Miami Dolphins slam Norman Braman, Marlins Park deal




















The Miami Dolphins ramped up their public campaign for a tax-funded stadium renovation this week, buying full-page ads against their top critic and trying to distance the plan from the unpopular Marlins deal.

The team bought an ad in Tuesday’s Miami Herald and El Nuevo Herald knocking auto magnate Norman Braman’s criticism of the Sun Life Stadium deal, which would have Florida and Miami-Dade split the costs with owner Stephen Ross for a $400 million renovation. The Dolphins would pay at least $201 million, with taxpayers using state funds and a higher Miami-Dade hotel tax to pay $199 million.

In a fact sheet sent to media Tuesday morning, the Dolphins listed ways their deal differs from the 2009 Marlins deal. First: Ross, a billionaire real estate developer, would use private dollars to fund at least 51 percent of the Sun Life effort, compared to less than 25 percent from Marlins owner Jeff Loria. Second, Sun Life helps the economy more than the Marlins park does.





“Just because the Marlins did a bad deal doesn’t mean we should oppose a good deal where at least a majority of the cost is paid from private sources and more than 4,000 local jobs are created during construction alone,” the fact sheet states. And while the Dolphins’ Miami Gardens stadium has hosted two Super Bowls since 2007 and is in the running for the 2016 game, “Marlins Stadium does not generate the ability to attract world-class sports events -- other than a World Series from time to time depending on the success of the team.”

NFL teams play eight home games a year if they don’t make the playoffs, while baseball teams have 81.

Miami and Miami-Dade built the Marlins a $640 million stadium at the site of the Dolphins’ old home at the Orange Bowl in Little Havana. The Marlins contributed about $120 million and agreed to pay between $2.5 million and $4.9 million a year for 35 years to pay back $35 million of debt the county borrowed for the stadium. As a publicly owned stadium, the Marlins ballpark pays no property taxes. Most of the public money came from Miami-Dade hotel taxes, along with $50 million of debt tied to the county’s general fund.

Sun Life is privately owned and pays $3 million a year in property taxes to Miami-Dade. It currently receives $2 million a year from Florida’ s stadium program, a subsidy tied to converting the football venue to baseball in the 1990s when the Marlins played there. The Dolphins also paid for a second full-page ad with quotes from leading hoteliers in Miami-Dade endorsing the stadium plan. Among them: Donald Trump, whose company recently purchased the Doral golf resort. “Steve Ross’ commitment to modernize Sun Life Stadium -- while covering most of the construction costs -- is the right thing for Miami-Dade,’’ the ad quotes Trump as saying.

Also on Tuesday, Ross and team CEO Mike Dee sent a letter to Miami-Dade Mayor Carlos Gimenez and county commissioners requesting negotiations over the stadium deal. The letter said the deal Ross unveiled last week is a “baseline for debate” and asked for talks. The letter also urged the commission to adopt a resolution proposed by Commissioner Barbara Jordan endorsing the state bill that would allow taxes for Sun Life. The resolution is on the agenda for Wednesday’s commission meeting.

Gov. Rick Scott approves no-bid Glades deal




















Gov. Rick Scott and the Florida Cabinet unanimously approved the request of two agriculture companies Wednesday to allow them to renew their leases to farm state land in exchange for them swapping other parcels for Everglades clean-up efforts.

Scott, along with Attorney General Pam Bondi, Agriculture Commissioner Adam Putnam and Chief Financial Officer Jeff Atwater ignored concerns of environmental groups across the state that the conditions of the leases to A. Duda & Sons and Florida Crystals were overly generous and would limit the state’s options for cleaning up the Everglades in the future.

The environmentalists urged the Cabinet to slow down and re-negotiate a shorter-term lease that gives the state the options it may need if the restoration projects require more land. But Melissa Meeker, executive director of the South Florida Water Management District, told the Cabinet there would be no need for their land.





"The parcels where the leases are so far outside where any potential project would be…far from any footprint where we would be looking for any projects,’’ she said. "We feel very confident that we have the land we need.’’

The environmental groups said they will take their appeal to the water management district board, which must approve the lease agreements.

"We still hope they will reduce the length of the lease,’’ said Charles Pattison of 1000 Friends of Florida. He said that if the state decides it needs additional land covered under the leases, it could be on the hook to pay the growers for lost income from farming.

The sugar companies argued that every acre of land that remains in farming — including state land — equals jobs for their employees.

"Every time we take land out of production it costs jobs,’’ said Gaston Cantens, vice president of Florida Crystals. "Everyone likes to beat up on us."

Why the Future of TV Still Isn’t Here Yet






As content providers continue to intimidate tech companies with a seemingly endless couch-potato conundrum, the latest innovation in the war to win your living room isn’t some new gadget from Apple or Netflix, or even that exciting à la carte content delivery system from Intel — it’s a protocol that helps our screens better communicate with one another. YouTube and Netflix have teamed up to create something called DIAL, a competitor of sorts to Apple’s AirPlay, which, as GigaOm’s Janko Roettgers describes it, ”helps developers of second-screen apps to discover and launch applications on smart TVs and connected devices.” Basically, it turns your phone into a kind of wireless super-remote for your TV, as Roettgers explains: 



With DIAL, the Netflix app on your phone will automatically discover that there is a device with a Netflix app connected to your TV. It will fire up that app, and then the two apps are free to do whatever they want — which presumably involves some healthy binge-viewing.







This solves a “big problem” because it makes using those apps on your smart television a lot easier.  As of right now, controlling the Netflix app on a PlayStation still requires the console remote to open up the app on your television before controlling it from a phone or tablet. This eliminates a step — and that, ladies and gents, is the biggest thing actually happening in TV tech right now. Instead of letting us pay just for the content we want, the cable industry’s aging model is still forcing tech companies to help us sift through all the extras were forced to buy. Because with the big media companies refusing to budge on innovative content deals so far this year, “content discovery” tools like GIAL and AirPlay remain one of the only ways everyone can get along.

It wasn’t supposed to be this way, of course. Many expected hardware like a supped-up Apple TV or the Roku streaming stick to “fix” television — instead of some protocol that makes finding stuff on our TVs easier. But, as Netflix discovered when it tried to get in the hardware business, the total package can alienate the other key players. Back in 2007, the streaming company had a set-top box in the works that would transform Netflix into a cable competitor, reports Fast Company’s Austin Carr. But CEO Reid Hastings scrapped the idea because it was too competitive. “We could not be competing against Sony, LG, and Samsung,” says Steve Swasey, then the company’s VP of communications. On top of the potential loss of support from hardware makers, this separate Netflix box scared away the content owners, with which Netflix has worked so hard to get streaming TV deals.

The old-school media industry’s fear of tech-world competition has driven the future of television in a spiraling direction. When one of the too-many entities gets offended, the future falls apart, as we saw with Google TV in an experiment that ultimately scared off content providers as well. A protocol like DIAL is the politically correct solution: It doesn’t change how we pay for content — but it sure does work within the comfortable way we’re used to sitting down and watching TV!

Batman Star Christian Bale Thrills 8-year-old Cancer Patient with Personal Call

Christian Bale received his share of negative publicity after audio surfaced of him angrily ranting on the set of the 2009 action movie Terminator Salvation. But the Dark Knight actor has done a lot to change that image since, including his recent gesture to an 8-year-old Batman fan suffering from cancer.

As we can see in this video posted on YouTube by the parents Leukemia sufferer Zach Guillot, Bale clearly gives the boy a thrill by calling him in his hospital room and chatting with him about his role in the Batman franchise.

No charges against 2nd person in Texas college shooting

HOUSTON — Authorities say they don't expect to file charges against a 25-year-old man who was involved in an argument that escalated into gunfire at a Houston-area community college.

The two men who were arguing and a bystander were shot in the incident Tuesday outside the library at the North Harris County campus of Lone Star College.

Authorities have charged 22-year-old Carlton Berry with two counts of aggravated assault with a deadly weapon.

Harris County Sheriff's Office spokesman Thomas Gilliland said Wednesday the other man, identified in court records as Jody Neal, did not have a weapon.

Texas campus issues alert amid reports of shooter




















A Texas college has gone into a lockdown amid reports of a shooter on campus.

Jed Young, a spokesman for the Lone Star College System campus in north Harris County, told The Associated Press that a shelter-in-place order has been issued.

Emergency personnel have responded to the Houston-area college campus.





The Harris County Sheriff’s Office had no immediate details.

The shooting happened sometime shortly past noon at the campus, according to the Sheruff’s Office, the Houston Chronicle reported.

Initial reports indicate at least three people may have been wounded. No other information about injuries was immediately available.

"We know that shots have been fired and we are in a shelter-in-place situation on the campus," Vicki Cassidy, manager of media relations for Lone Star College System, told the Chronicle. "It's a pretty chaotic scene at this point in time."

Cassidy said she could not provide any other details about the shooting. The campus is one of six that makes up the community college system.

Early reports indicate the shooting may have occurred in the library as well in the cafeteria.

The campus has been placed on lockdown as authorities investigate the case. Officials asked students and faculty to remain where they are on the campus. They also ask other people not to come to the campus.

Apple slips, BlackBerry slides and Windows Phone stalls in December






Kantar Worldpanel’s December smartphone market share numbers are out. And they are as fascinating as ever. Kantar pegs the BlackBerry market share in America as 1.1% last month, down from 1.4% in November. Surprisingly, Windows Phone’s market share also ticked down to 2.6% in December from 2.7% in November. That might be a statistical artifact, but it is surprising not to see a substantial boost in Windows share considering the marketing support and new devices from AT&T (T).

In Europe, Windows Phone is rapidly picking up steam. Its market share soared to 13.9% in Italy from 11.8% in November. In the UK, Windows Phone’s share moved to 5.9% from 5.1% in a month.The EU average share of Windows Phone bloomed to 5.4% from 4.7% between November and December.

At the same time, BlackBerry dipped to 4.0% from 4.4%. The stage is set for the spring battle between Windows Phone and BlackBerry camps.


Interestingly, Apple’s (AAPL) share in the UK slipped to 32.4% in December from 36.1% in November. The massive popularity of Samsung (005930) models in the British market was undoubtedly the main reason; Android’s share hit 54.4% in the UK.


This is the latest sign that Apple’s market share problems outside the U.S. market are not limited to emerging markets and Southern Europe. The UK has traditionally been the second most loyal market to the Apple brand, right after the United States. High court: former Manhattan DA busted for felony pot sales

A former Manhattan assistant district attorney has been indicted for felony pot sales -- the very kind of crime he once prosecuted.

David Leung, 44, had been busted during a September buy and bust operation on East 9th Street. Leung was allegedly selling high grade weed through a delivery service.

He declined comment today as he left Manhattan Criminal Court, where he was informed of the indictment.

He's accused of selling to an undercover an envelope containing two bags of marijuana for $200. Cops with Narcotics Borough Manhattan South found another "two large bags" of marijuana in his trunk, according to the charges against him.

Existing home sales and prices rose in Broward in December




















South Florida’s housing recovery is on strong footing.

In Broward County, the median price of an existing single-family home surged 21.1 percent to $230,000 in December from a year earlier, according to the Greater Fort Lauderdale Realtors.

The median price of an existing condo or townhouse in Broward in December jumped 24.7 percent to $95,100 year over year, the group said.





Sales of single-family homes in Broward climbed 14.9 percent in December year over year while the volume of condo and townhouse closings increased 4.7 percent over the period.

The inventory of single-family homes in Broward fell 35.5 percent in December from a year earlier, while the inventory of condos and townhomes on the market declined 25.2 percent year over year, the Fort Lauderdale group said.

“Buyers are quite surprised there is not more inventory after everything they have been hearing,’’ said Eyvonne Kafourus, an agent with Prudential in Fort Lauderdale. “I see a lot of people coming in from other states, for job transfers and retirement.’’

“Buyers are getting aggravated because they are losing deals,’’ said Charles Bonfiglio, president of the Greater Fort Lauderdale Realtors. “Eighty to 90 percent [of sales] are multiple offer situations. They’ve got to move quickly.’’

The median days on the market for a single-family home in Broward declined to 37 days in December from 56 days a year earlier, the Realtors group said.

Florida has been seeing a flow of new arrivals after a period of exodus during the downturn.

“We’ve obviously turned the corner. We’ve noticed inventory tightening up,’’ said Philip Vias, a broker associate with Prudential in Fort Lauderdale.

Vias said more buyers seem to be coming in from the Northeast. “What’s held things up is homes weren’t selling up north. North it’s starting to trickle down.’’

Statewide in Florida, single-family home sales climbed 15.8 percent in December from a year earlier as the median price increased 14.1 percent to $154,000.

Lemurs run amok in North Miami Beach; scratch toddler




















It was a case of lemurs on the loose in one North Miami Beach neighborhood early Monday morning.

Julio Hincapie, who owns the two lemurs, said someone cut the locks on their cage and tried to steal them around 2 a.m.

The lemurs, however, had other ideas and ran wild through the neighborhood in the 2000 block of Northeast 73rdSt.





They charged at neighbors, launched themselves at police and at one point jumped on a toddler and scratched her face.

“They were scared. They were running around, everyone chasing them. There were a lot of lights,” said Hincapie. “They were scared.”

Rosemary Alonzo will never forget the screeching sound one made.

“A terrible sound, like a ‘roar’, very strong,” she said.

Surveillance video at her house shows a family quickly walking past with a lemur hot on their trail.

“I saw this lady running with a kid in her hands and a gentleman, it was terrible,” said Alonzo.

Her German Shepherd Thor went haywire trying to get it, as it walked the top of the fenceline.

“It was trying to fight and trying to scream at the dog,” said Alonzo.

One of the lemurs jumped on a two-year-old girl as she got out of the car with her mother. It jumped on her and scratched her face just under her eye.

Police and Hincapie finally managed to round-up the lemurs and put them back in their cage.

“In my 17 years, I have never seen anything like this. This is the first time I’ve been dispatched to a call like this,” said North Miami Beach Sgt. Richard Rand.

Rand said when he first got the call he thought he was being ‘punked’ by his fellow officers.

Neighbors familiar with the little lemurs said they are normally no threat.

“There’s nothing wrong with the monkeys. They’re very peaceful, we feed them and everything,” said Carlos Lezcano.

The Florida Fish and Wildlife Conservation Commission has launched an investigation into the incident.

Hincapie was ticketed for having an expired permit for the lemurs, and for allowing them to escape. But FWC officers say the caging for the animals is actually better than the state requires. They say he will be allowed to keep the animals.

Console gamers frustrated that their Xbox isn’t holding up well compared to high-end gaming PCs can relax a bit, because it looks like the next-generation Xbox is going to be a monster. It seems that website VGleaks has gotten ahold of leaked specifications for the Xbox 720, which it says will include an 8-core 1.6GHz processor, 8GB of RAM, an 800MHz graphics processor, a 50GB 6x Blu-ray Disc drive, and Gigabit Ethernet connectivity. The leaked specifications are in line with previous rumors that also gave the next-generation Xbox an 8-core processor and 8GB of RAM, so there’s nothing overly surprising about VGleaks‘ report. The Xbox 720 will likely be announced at the E3 gaming convention this June and will be released in the fall.

First ET Interview: Philip Seymour Hoffman Talks 'Magnolia'

Group holds gun control march and rally in NYC

Children join the hundreds who gather for the "One Million Moms For Gun Control" rally held at City Hall today.



A gun control group formed in the wake of last month's massacre at a Connecticut elementary school marched across the Brooklyn Bridge to City Hall on Monday to call on Congress to follow New York's lead and enact stricter limits on weapons and ammunition purchases.

One Million Moms for Gun Control said the event was inspired by the Rev. Martin Luther King Jr.'s message of nonviolence.

A cabbie drove by beeping his car's horn and flashing a peace sign as some 400 marchers from the city's five boroughs and several other states, including Michigan, Minnesota and Florida, crossed the bridge.




Valerie Wright of Manhattan said she would have felt "negligent" if she didn't attend.

"Even though we just passed legislation here, it's more far reaching than just our state," she said.

Wright said it was important to be counted in the call for similar laws nationwide. "Sometimes showing up is the best thing you can do," she said.

Jennifer Edwards, from Ann Arbor, Mich., said she was not against guns, but wants a nationwide ban on military-style guns.

"If the man at Sandy Hook had a regular gun instead of an assault weapon, half of those children would be alive," she said of the Newtown, Conn., tragedy. "You can never stop people from doing crazy things, but if you can minimize it, if you can save one life, isn't it worth it?"

One Million Moms for Gun Control wants Congress to pass President Barack Obama's sweeping gun control proposals. Those include a ban on assault weapons and large magazines and closing loopholes that allow some gun sales without background checks. The group also is pushing for boundaries on how much ammunition can be purchased and limits on the scope of concealed weapons laws.

Last week, New York Gov. Andrew Cuomo signed the nation's toughest assault weapon and magazine restrictions.

The rally began with the rendition of "26 Names" by Tony-nominated actress Montego Glover. The song is a recitation of the Newtown victims' names set to music by Tony-winning composer Jason Robert Brown. Twenty first-graders and six school officials were killed in the shootings last month at Sandy Hook Elementary School.

It ended with comments from Shannon Watts, the group's founder, thanking those who marched through the frigid morning and imploring them to keep the pressure on to get national laws passed.

An Indianapolis resident, Watts said she was inspired by the Sandy Hook shootings to act. Using social media, word has spread so that in just a few weeks more than 75 chapters formed, including the one in Brooklyn that sponsored the event.

Watts said she envisions the group modeling itself after Mothers Against Drunk Driving, and hopes to lead a fight nationwide with rallies planned for next week in Washington and other cities.

"It's going to be a steady drip," she said. "We are not going to give up."

She acknowledged that others have fought the issue before, but said that the elementary school shooting was a turning point.

"This is a new generation of moms," she said.

Indeed, many in the crowd said they were galvanized by Newtown. Rachael Dubin, of Brooklyn, said she had never been involved in previous efforts to enact stricter gun laws, but the shootings were too close to home for the mother of a 2-year-old and a 5-year-old.

"It's the 5-year-old that really made what happened in Newtown so jarring," she said. "I think there absolutely needs to be national legislation, and I hope it's tougher than what was done in New York state."

The newcomers to the cause were joined by those who have been calling for stricter gun laws for years.

Jackie Rowe Adams, founder of Harlem Mothers SAVE (Stop Another Violent End), has buried two children because of gun violence.

"We can't bring our kids back, but we can certainly continue to do prevention, to do education and to do what we can to end the violence," she boomed at the rally.

Johnnymae Robinson lost her son in 1999, and marched in the Mother's Day rally in Washington in 2000 that was dubbed the "Million Mom March." She thought the strength of that effort would produce a bigger effect, she said, and hoped the momentum building now will produce some change.

Several members of the City Council, state Assembly and Senate joined the rally. Among them was Police Commissioner Ray Kelly, who has long called for stricter gun laws. He called the event a manifestation of the growing momentum for change. The commissioner said tighter laws on assault weapons are a start, but also added that handguns are used in most of the crimes within the city — most of them brought into New York illegally.

"We need a national policy to address that," he said.

Bennett Windheim of Manhattan brought his wife and son.

"This is a signal in support of what the president wants to do and sends a signal to legislators across the country that there's support for the president's initiatives."

Miami Heat sign Chris “Birdman” Andersen




















LeBron James admitted Sunday that playing against bigger teams has “worn” on Heat players at times this season. So has the frequent pounding on the boards, with Miami next-to-last in the league in rebounding.

On Sunday, the Heat did something to address both, adding 6-10 veteran forward/center Chris “Birdman” Andersen to a 10-day contract. Miami also re-signed center Jarvis Varnado to a second 10-day contract.

“I’m overwhelmed, ecstatic to be here, grateful for this opportunity,” said Andersen, who last played in the league for Denver last season, where he averaged 5.3 points, 4.6 rebounds, 1.4 blocks and 15.2 minutes in 32 games.





“Being with the defending champs, it’s a dream come true. They’re taking a chance with me and I’m here to give them everything I've got – defensively, diving on the floor, blocking shots, the usual [stuff] Birdman brings. It’s a great fit for me.”

Coach Erik Spoelstra said Andersen’s “skill set fits the style of basketball we like to play. Typically, you’re not able to get a player of his caliber this time of year. Three years ago, he was the best at the game coming off the bench at his position as a shot-blocker and a rebounder. This [move] unanimously made sense to everybody.”

Nicknamed “Birdman” by teammates years ago because he jumps and “flies around” on the court, the 34-year-old Andersen has averaged 5.4 points, 5.2 rebounds, 1.6 blocks and 17.8 minutes in 482 games (including 10 starts) over 10 seasons, while shooting 50.8 percent from the field.

“We’ve always liked him,” Spoelstra said. “We had him in our camp a long time ago, when he was pre-tattoo. Ever since that day, we’ve searched for ways to get him back but there was no way to pry him from Denver. He has a lean body, a live body even at his age. Even with a lot of time off, he still had his quick twitch and his athleticism.”

Spoelstra was non-committal about how much he would play immediately, saying he “needs to learn our system first, though you can see he fits in very well with what we do.”

The Heat’s stars endorsed the move. “It has to make us better on paper. We’ll see when we get in the game,” Dwyane Wade said. “What he brings is his energy, effort, uncanny ability to rebound and block shots. It’s a great addition when you can a guy to your team that can help you and you don’t have to worry about fitting him in offensively.

“He’s kind of like a [Udonis Haslem]. Certain guys you respect because every time they get on the floor, they put their all into it. They’re game changers in a sense. You always look at guys like him and say, ‘That’s a guy you would love to have on your roster.’ We’ve always had one with U.D. Now to be able to add another one is good.”

James likes that Andersen plays with a chip on his shoulder: “That’s what we need. We love guys with chips. Hopefully he plays with that type of intensity.”

Center Chris Bosh, who averaged just 4.6 rebounds on the Heat’s six-game road trip, said Andersen “is a great defender. He’s just very active.”

Andersen had minor arthroscopic knee surgery in August, and said he “didn’t even know if I would play this season.” But he’s healthy now and in one of several references to himself in the third person, said the knee procedure “isn’t going to keep the Birdman from flying in there and banging and getting rebounds.”

Notre Dame football star says he was not in on hoax – ESPN






(Reuters) – Notre Dame football star Manti Te’o has denied ever being in on an elaborate hoax, telling ESPN he had believed his relationship with a woman who turned out to be an online fabrication was real.


The tragic story of his girlfriend and her injuries from a car accident and death from leukemia was one of the most widely recounted U.S. sports stories last year as Notre Dame made a drive toward the national championship game.






“I wasn’t faking it,” Te’o told ESPN in an off-camera interview on Friday, excerpts of which were posted on ESPN.com. “I wasn’t part of this.”


When asked whether he had made up the tale to support his chances of winning the Heisman Trophy, the highest individual honor for a college football player, Te’o replied: “Well, when they hear the facts they’ll know. They’ll know that there is no way that I could be part of this.”


The interview was Te’o's first since the sports blog Deadspin.com on Wednesday exposed the heart-wrenching tale of his girlfriend, Lennay Kekua, and her death as a hoax and that a friend of Te’o's named Ronaiah Tuiasosopo was behind it.


Te’o told ESPN that Tuiasosopo called him on Wednesday and admitted he was behind the hoax and it was then Te’o was sure the woman had never existed.


“I don’t wish an ill thing to somebody,” Te’o said of Tuiasosopo, according to ESPN. “I just hope he learns. I think embarrassment is big enough.”


Outside Tuiasosopo’s home in Palmdale, California, on Thursday, a member of his family who did not identify himself told reporters they had no comment.


Te’o acknowledged in a statement on Wednesday that he had never met the woman in person, though he considered her his girlfriend and said he had been duped.


In the ESPN interview, Te’o said he tried to video chat with her several times, but she could never be seen on the other end. He also said he intentionally told people stories about her in a way that would make people believe they had met in person.


“I even knew that it was crazy that I was with somebody that I didn’t meet,” Te’o said.


NATIONAL PROMINENCE


ESPN said the interview was held at a training facility in Florida where Te’o has been preparing for the National Football League draft. The star linebacker was expected to be a high draft pick before the hoax was revealed.


Te’o sprang to national prominence last fall when he led Notre Dame to a victory over Michigan State within days of learning his grandmother and girlfriend had both died. The grandmother’s death was real.


The story grew to become a big feature in coverage of the team, which went undefeated in the regular season and reached the national championship game. Alabama defeated Notre Dame in the title game on January 7.


Notre Dame, one of the most powerful institutions in U.S. collegiate athletics, held a news conference within hours of the Deadspin.com article to say that Te’o had been duped.


Notre Dame Athletic Director Jack Swarbrick said on Friday the Indiana university was comfortable, based on a private investigation it launched and on four years experience with Te’o, that he was the victim and encouraged Te’o to speak publicly.

Manti Te'o to be interviewed on-camera by Katie Couric

Notre Dame linebacker Manti Te'o will be interviewed by Katie Couric, the first on-camera interview given by the All-American since news broke about the dead girlfriend hoax.

Te'o and his parents will appear on Couric's syndicated talk show Thursday. ABC News announced the interview Sunday, but gave no details as to when it will take place and where.

Te'o gave an off-camera interview with ESPN on Friday night. He insists he was the victim of the hoax, not a participant. The Heisman Trophy runner-up said he had an online romance with a woman he never met and in September was informed that the woman died from leukemia.

Investors await word from Apple




















No company today elicits such devotion and dedication among its customers and shareholders like Apple. The fervor felt by Apple fans for its products, its leaders and its business underscore the company’s technological eco-centric strategy. While that loyalty has made for rich rewards over the long term, it will mean very little to a myopic stock market when Apple reports its latest financial results Wednesday.

When a company so dominates a business like Apple does, it is subject to plenty of rumors, especially when that company, like Apple, is disciplined to not respond to speculation. There have been a series of anonymous and Wall Street analyst worries floated in the past quarter centered on the iPhone 5. First were concerns Apple couldn’t get enough supplies to build the phones fast enough. Then there were hints Apple cut its supply orders, suggesting slower sales.

Apple optimists have been quick to defend the company even as its stock has fallen from $700 to around $500 per share since September. The stock drop has come even as Apple probably sold a record number of iPhones and iPads during the holiday quarter.





No doubt Apple will trumpet its financial prowess on Wednesday. And it should. After all it generates more than $500 million dollars a day. But the short-sighted stock market has been conditioned to expect big numbers. Therein is the challenge for Apple: incubating such devotion without inflating expectations.
